Resident Return Visa
Can You Return to Australia After Being Away for 10 Years as a Permanent Resident?
Ten years overseas does not automatically make return as a permanent resident impossible, but having once held permanent residence does not guarantee re-entry at any time. The answer depends on visa history, recent residence, substantial ties to Australia, reasons for prolonged absence and the supporting evidence.

The expression “my Australian PR expired after five years” often confuses a permanent visa with its travel facility. A permanent visa permits indefinite stay in Australia, while return from overseas as a permanent resident requires a valid travel facility. A permanent resident in Australia with an expired travel facility does not need an RRV merely to remain, but ordinarily needs one before returning as a permanent resident after overseas travel.
What should be checked first?
Check grant records, VEVO and movement records to establish whether the last permanent visa was cancelled, when its travel facility ended, the person's status on last departure, and any later visa grants. Home Affairs says a current permanent resident, a former permanent resident whose last permanent visa was not cancelled, or a former Australian citizen who lost or renounced citizenship may be able to apply, subject to the relevant grant criteria.
Does 730 days in Australia secure a five-year travel facility?
The clearest route is presence in Australia for at least two years—730 cumulative days—during the five years immediately before lodgement, as a permanent visa holder or Australian citizen. Arrival and departure days are counted. Meeting this residence requirement generally results in a five-year travel facility. A person absent for ten years will usually need another route, but the calculation should still be completed using exact dates.
Can someone qualify without two years of recent residence?
Potentially. Subclass 155 provides pathways based on substantial business, cultural, employment or personal ties that are of benefit to Australia. The enquiry is not whether one Australian asset exists, but whether the ties are genuine, substantial, continuing and beneficial to Australia.
| Type of tie | Possible facts and evidence | What does not decide the case alone |
|---|---|---|
| Business | Active operations, management authority, contracts and continuing transactions | A company registration or bank account alone |
| Cultural | Continuing Australian cultural, artistic, professional or community participation | A one-off membership or event |
| Employment | Australian employment, a documented role or a genuine continuing work arrangement | A general intention to seek work |
| Personal | Long residence history, close family, Australian-citizen children, community participation and Australia as home | Property ownership or an intention to return alone |
Why do reasons for a long absence matter?
For an applicant outside Australia, the applicable criteria may require compelling reasons for a continuous absence of five years or more, or for relevant absences totalling more than five years, depending on the person's status and history. Home Affairs examples include serious illness or death in an overseas family, work or study commitments, living overseas with a partner or minor children, lengthy medical treatment, legal proceedings beyond the applicant's control, and natural disasters, political unrest or a pandemic.
Is Australian property or a bank account enough?
Not necessarily. Property, accounts, tax records and family connections may form part of the evidence, but the nature, strength and duration of the ties—and whether they benefit Australia—must be assessed together. An isolated asset does not replace the wider factual history.
Can a person return on a temporary visa after the travel facility expires?
Do not assume this is risk-free. Home Affairs warns that returning without a permanent visa and valid travel facility—for example, on a visitor visa—might affect permanent-resident entitlements and the ability to satisfy permanent-residence requirements for citizenship or another RRV. Current status and the RRV pathway should be checked before travel.
How should a ten-year absence case be prepared?
- Collect permanent and later visa grants, VEVO results and complete movement records.
- Count qualifying Australian residence during the five years before the intended lodgement date.
- Organise business, cultural, employment and personal ties separately and explain their benefit to Australia.
- Build a complete absence timeline with contemporaneous evidence supporting the reasons for prolonged absence.
- Check location, travel timing, passport details and each family member's separate position.
- Do not rely solely on property, accounts or a wish to return, and do not switch to a temporary visa without first checking the consequences.
